Out of Order - Use Stairs



Sorry folks, but until I resolve my problems with my ISP, there won't be any updates or re-ups for a while.

I am not only getting consistantly slow speeds, but found that they have throttled down uploads, making album-sized zips nearly impossible. I am speaking to half of Southern Asia all about it, but to no avail. And being locked into an annual contract means I can't take my business elsewhere.

Plus, I've really reached that saturation point with music where I'm not doing other things - especially creative stuff. So maybe this is happening for a reason. Sorry to the many who have emailed or commented for a particular album. It might happen, but I can't say when. Please do check in, as an alternative solution may present itself, or I might feel inspired to blog about other blogs.

Not the end, but the start of something else.

If the throttling down and other restrictions were not part of the contract you signed, they can't change the terms without voiding the contract.

Call the business office and talk about "bat & switch" and "breach of contract" and insist they provide you with the service you contracted with. Keep repeating the phrase, "I'd like to speak with your supervisor" and "I contracted for service which isn't being delivered; that's fraud." Also, if they changed the terms and conditions by sending you noticed with your bill that's also fraud. One party can't change the terms of a contract without the other party's consent.

My guess is they'll cancel your contract to get rid of you.

Always glad to see you around. Sorry to let you down; I hadn't anticipated quitting just yet, but was also suffering from the same syndrome that some of the dearly departed blogs had.

I will always be around in one form or another.

I am pursuing those options. Perhaps because of similar complaints, my ISP (Earthlink)they are nearly impossible to contact. I am thinking of drafting a formal snail-mail letter and sending it to their business address.
Download speeds have been consistently half of what we contracted for and uploads suddenly have slowed to a crawl.

Customer service is expensive, so most companies make it as difficult as possible. Every time you call they lose money.

That's the way to proceed. Send it to the legal department -- more of a clue -- certified mail, return receipt, because that shows you care. And this will get their attention.

There you go. That's breach of contract. Earthlink cannot unilterally change the contract you agreed to.

All you have to say is: Here's what I contracted for... Here's what I got... Here's what your customer service people said... Either give me what I contracted for, or make arrangements with me to close the account, with notice, so I can move to another provider.

Or, you could say, "Here's what you promised me, here's what you delivered, here's what you said when I complained. Because of your breach of contract, I'm moving to another provider effective DATE, please close the account." Then dispute the charge on your credit card, saying it was fraudulent. They'll leave you alone.
